This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name https://www.secureout.com/ (the "Site"); the Site together with its Content, Marks and any other allied Application meant for the integration of the Users shall hereinafter be referred to as "Platform"

The Platform is operated by Synctric Technology Private Limited, a company incorporated under the Companies Act, 2013 with CIN – U72900GJ2022PTC133276, having its registered office at Nippon Q1 Mall Ernakulam Kochi (hereinafter referred to as "Company").

Your use of the Platform and services and tools are governed by the following terms and conditions "Terms of Use" as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact and/or use the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with Company and these terms and conditions including the policies constitute Your binding obligations, with Company.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who is using or interacting with the Platform by providing relevant registration data while registering on the Platform as registered user using the computer systems or can also refer to an unregistered User. Company allows the User to surf the Platform or making purchases without registering on the Platform. The term "We", "Us", "Our", "Company" shall mean "Synctric Technology Private Limited".

When You use any of the services provided by Us through the Platform, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Company Policies including but not limited to Privacy Policy as amended from time to time.

The Services are not meant for persons under the age of 18. If you are under 18 years of age, then please do not use these Services.

You are solely responsible for maintaining the confidentiality of Your Registration Data and Application login credentials, and will be liable for all activities and transactions, and any other misuse of the Application, that occurs through Your Account (whether initiated by You or any third party), except to the extent caused or contributed by the Company.

You must also notify the Company immediately if You cannot access Your Account, You know of or suspect any unauthorized access or use of Your Registration Data, login details or Account, or the security of Your Account has been compromised in any way.

The Company and/or any of its Third-Party Service Providers may suspend access and Service subscriptions entered into if:

1. The Registration Data or any other information provided by You is false, or You cease to satisfy the Eligibility Requirements.
2. The security of Your Account has been compromised in any way; or
3. You have not complied with any of the requirements in this clause.

The Company and/or any of its Third-Party Service Providers may block, suspend, alter or update the Website, the Platform Services and/or the Services at any time (including without notice):

1. To make improvements to the Website, the Platform Services and/or the Services (including the security of the Website, the Platform Services and/or the Services);
2. As required by Applicable Law; or
3. To protect a legitimate business interest.

The submission of false or deceptive content may lead to account suspension or termination. SecureOut reserves the right to delete, modify, or reject any user-generated content that violates these Terms and Conditions or is deemed inappropriate, misleading, or harmful to the integrity of the platform.

Users shall not use automated tools, bots, or scripts to scrape, extract, or manipulate data from our Website.

Users accept that our reports and assessments are for informational purposes only and should not be solely relied upon for making financial or business decisions.

Services Provided

SecureOut provides an online platform that assesses the legitimacy, security, and reputation of websites. Our evaluations are based on publicly available data, user reviews, and third-party sources.

Nature of Assessments

1. Our assessments use automated algorithms, public domain data, and user-generated reviews.
2. We do not perform manual investigations (unless specifically requested by a user) into every website but rely on predefined parameters and statistical models.
3. We conduct manual investigations, and provide the same as an additional service to our users, in case any user requires a manual investigation to be performed on any website, they may contact us through the platform by raising an appropriate query.
4. The evaluations are dynamic and may change over time based on newly acquired data.

No Guarantee of Accuracy

1. We strive for accuracy but do not guarantee that our reports will always reflect the actual trustworthiness of a website.
2. Users are advised to conduct their own research before making financial or personal decisions based on our assessments.

Use of SecureOut Services

SecureOut strives to provide accurate scam detection reports based on data analysis and user contributions; however, it does not guarantee 100% accuracy. The information offered on the platform serves as a risk assessment tool, and users should exercise discretion before making any financial or personal decisions based on these reports. SecureOut shall not be held liable for any financial loss, data breaches, or security incidents resulting from users relying on its assessments. The service is intended to identify potential threats and should not be used as the sole basis for decision-making.

Users are strongly encouraged to conduct additional verification before sharing sensitive information with any third-party websites.

Reporting Scams and Reviews

Users may report suspected fraudulent websites through SecureOut's portal, ensuring that all submissions are based on genuine experiences or verifiable data. Reports should be made in good faith and must not contain misleading or false information. Reviews submitted to SecureOut must be objective, constructive, and devoid of defamatory language. Any attempt to manipulate reviews for personal advantage, competitive gain, or malicious intent is strictly prohibited. SecureOut reserves the right to investigate and verify all reported scams. Reports that lack sufficient evidence, credibility, or violate the platform's guidelines may be rejected or removed at SecureOut's sole discretion.

Limited License

Subject to the terms and conditions herein, the Company hereby grants you a limited, revocable, non-exclusive and non-transferable license to use its website/application and other related services (including all the updates and/or upgrades as and when provided).

The said license is solely for private and non-commercial use/purposes and is subject to the user adhering to these Terms and Conditions, Privacy Policy and any and all additional guidelines as and when updated by the Company.

Privacy and Data Protection

SecureOut is committed to protecting user privacy and ensuring data security in compliance with applicable laws. Personal information collected is used solely to enhance services and strengthen fraud prevention measures. SecureOut does not share user data with unauthorized third parties; however, it may collaborate with law enforcement agencies, cybersecurity organizations, or other relevant authorities when necessary. Users are strictly prohibited from misusing SecureOut's data or attempting to extract, manipulate, or exploit information for unlawful purposes, and any such actions may result in legal consequences and immediate account suspension.

Prohibited Activities

Any unauthorized access to SecureOut's platform, attempts to manipulate its algorithms, or the distribution of harmful, abusive language or defamatory content will not be tolerated. Users are also prohibited from exploiting SecureOut's services for personal or competitive gain, and violations of these terms may result in account suspension or legal action.

Limitation of Liability

SecureOut provides scam detection services based on available data and analytical assessments; however, it does not guarantee absolute accuracy. Users acknowledge that SecureOut is not liable for any financial loss, reputational damage, or adverse effects resulting from reliance on its services. Furthermore, SecureOut does not assume responsibility for user-generated content or the activities of third-party websites, and users are encouraged to exercise discretion before making decisions based on the platform's assessments.

Intellectual Property Rights

The Website and all associated intellectual property rights ("IP") remain the property of the Company or its third-party licensors. Except as expressly stated, nothing in these Customer Terms grants the Customer any rights in or related to the IP, and all rights not expressly granted to the Customer are reserved by the Company.

The website/application and other related services are owned and operated by the Company. The content, visual interfaces, information, graphics, design, compilation, computer code, products, software, algorithms, services, and all other elements of the Services (hereinafter referred to as "Company Materials") that are provided by the Company are protected under the relevant Copyright, Trademark, Patent laws/statutes, international conventions, and all other relevant intellectual property rules and regulations.

SecureOut retains full ownership of all intellectual property associated with its platform, including its algorithms, website content, and proprietary scam detection methodologies. Users are strictly prohibited from reproducing, distributing, or modifying SecureOut's proprietary information without explicit authorization, and any unauthorized use may result in legal action.

Disclaimers; No Warranties

Without limiting any other provision of this section and in addition to all other provisions of this section, to the fullest extent permitted by applicable law, the Company expressly disclaims all warranties and conditions of any kind, either express or implied, including without limitation any implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement of third party rights, and those arising from a course of dealing or usage of trade, with respect to the services.

The Company makes no warranty that the services will meet your requirements, or that they will be uninterrupted, timely, secure, or error free. The Company does not make any warranty or representation as to the use or the results that may be obtained from the use of their services.

You acknowledge that the services may be subject to operating errors or defects including, but not limited to loss of data, delays, non-deliveries, errors, system down time, mis-deliveries, network or system outages, file corruption, or service interruptions. No such event shall constitute a breach of this or any other contract on the part of the Company, even if caused by the negligence or gross negligence of the Company or any of its affiliates, employees, agents, licensors or subcontractors.

Certain state laws do not allow limitations or implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, in such cases, the Company's liability will be limited to the extent permitted by law.

Indemnification

Users agree to indemnify and hold SecureOut, its affiliates, employees, and partners harmless from any claims, losses, damages, liabilities, including attorney's fees, arising out of your use or misuse of the Service, violation of these Terms, violation of the rights of any other person or entity, or any breach of the foregoing representations, warranties, and covenants.

Account Suspension and Termination

These Customer Terms continue until such time as they are terminated by the Company in accordance with terms hereunder.

SecureOut reserves the right to suspend or terminate user accounts without prior notice if users violate these Terms and Conditions, engage in fraudulent activities, submit false reports, misuse platform features, or compromise the security and integrity of the service. Termination may also occur due to legal or regulatory compliance requirements.

The Users agree that the Company may at its sole discretion terminate any account (or any part thereof). In addition, the Company reserves the right to discontinue any aspect of the Service at any time, including but not limited to the right to discontinue the display of any licensed content, linked or embedded content etc.

SecureOut shall in no event be responsible for the deletion, loss of, or failure to store your content. You agree that any termination of your access to the Service or any account you may have or portion thereof may be effected without prior notice, and you agree that the Company will not be liable to you or any third party for such termination.

Amendments to these Customer Terms and Conditions

The Company may amend the terms of these Customer Terms and shall keep you updated regarding such amendments. We may change these Terms at any time by updating them on the Website. Unless stated otherwise, any change takes effect immediately. You are responsible for ensuring you are familiar with the latest Terms. Dispute Resolution and Legal Recourse

The venue for such arbitration shall be Ernakulam, Kochi or Surat Gujarat, and the arbitration shall be conducted in the English language. The decision of the arbitrator(s) shall be final and binding on all parties involved.
